What Brexit means for you Members  

If you've not considered the implications of Brexit for you personally, you must do this now. This Government tool is a good starting point. This is intended as a resource to raise areas for consideration but you must undertake your own research and make your own business decisions. This is not legal advice. If you're based in the UK, EU or somewhere else, there will be different implications.  We're focusing on the implications for those based in the UK. This signposts areas to be aware of, however you must make your own enquires.

Privacy and Cookie Policies

The UK will no longer fall under the EU GDPR legislation. Instead it'll have the UK GDPR legislation, which will be practically identical. As before, it needs to be read alongside the UK's Data Protection Act 2018. Another key piece of legislation, the PECR (Privacy and Electronic Communications Regulations) is derived from EU legislation, but is already part of our domestic law. You may need to update your relevant policies to reflect the change to the UK GDPR. This will likely include your Privacy Policy and Cookie policy and any internal policies you may have, for example, a staff data protection policy.

Data Transfer

There are changes to the way in which data can lawfully flow between two countries. How this affects you will depend on where you're based (e.g. UK, Europe, USA), and who you trade with (companies, sole traders or private individuals), and if you provide goods (e.g. prints, merchandise) or services (e.g. licensed artwork or agency services).
